Tips on Writing an Affidavit

An affidavit is a statement that is put in writing by a person to help with a case hearing, mainly done through an oath or affirmation. Most of the affidavits are also used in courts as evidence and are rendered reliable just as any of the materials and goods provided before a court of law. The difference between a lousy affidavit and one that can be used in a court of law are the steps followed in writing the same. The main things to be recorded in the heading known as the case caption which should be the first thing to do before writing an affidavit should be the names of the defendant and the plaintiff, the case number and the venue to which the proceedings of the court are to be done. In bold one should encrypt the name affidavit just below the case caption that will help in signifying the kind of document that it is. The heading goes as the first agenda and then the second agenda is writing ones personal information which includes the name of the person, the address of the affiant, the job occupation and the marital status if need be. The affidavit starts with the affiant name before everything else who is the person that swears the affidavit. The statement of an affidavit provides the most sensitive part as most of the writings here should be done to precision for it to hold any grounds in a court of law.One should write the statements using facts and not opinions which should be stated in numbers for easier referencing in court.

One should note that an affidavit should occur as a person speaking to the court so should have the beginnings of paragraphs with letters such as ‘I’ to denote the persona and the facts laid out well with each fact taking its paragraph. There are times where the affidavit can provide facts that are interlinking and cannot be separated from one another, such cases will be helped by the affiant outlining each fact well but in the same paragraph. The different facts that are provided by the affidavit should have supportive documents and dates and addresses to verify the truth of the affiant. The affidavit should have a part that shows the person swears that all the statements were written are in fact precise and clear. One should not forget to put a block that shows the signature of the affidavit. The affiant should not only sign the document, but there should be someone witnessing the activity; notaryThe notary as well should provide his/ her signature at the bottom following the signature of the affiant.
